Legal Question in Real Estate Law in New Jersey

Unpaid Condo Assessment Fees

There is a unit owner of our Ocean City NJ Condo Association that after a year has not paid her assessment fees. She is in the process of selling her unit what can we do? Is there a letter that we can send her requesting payment and putting a lien against her property?

Re: Unpaid Condo Assessment Fees

Most condo documents allow filing of a lien, which will require payment and discharge before the new owner can close. Even without a filed lien, you most likely will be contacted by the Buyer's attorney or title company to check the status of the account since they will want this cleared up before they take ownership.

Review your documents and discuss this with your attorney to decide if you should file the lien.
