Legal Question in Real Estate Law in New Jersey

Vacating Firestation Easement

I own waterfront property next to a vacant waterfront propertyowned by someone else . There is currently a firestation easement which was used before a fire hydrant was placed at the end of our dead end street. Can the person who does not own this property request to vacate this easement and would this easement portion of the property revert to the person requesting the vacating. I have tried speaking with various members at our municipal

offices, I seem to be getting the run around.

Any help I certainly would be grateful

Re: Vacating Firestation Easement

In general, the person who has the easement on his premises is the only one who has the ability to attempt to have the easement vacated because he is the only one against whom the easement would have an impact. It may be as easy as getting the proper fire department official to sign a deed reconveying the easement interest to the property owner. Or, depending on other factors, a Court determination may be required to clear up this situation. If you want me to assist you, please call my office at 856-546-8010. Good luck!
