Legal Question in Real Estate Law in New Jersey

Water Run off from neighbors property

A new house was built next to my son's driveway.. which is next to my property.. and he filled in his property pretty high so all water runs off onto my son's driveway and floods it pretty bad. The neighbor recently installed underground pipes so that the water from his leaders runs off onto my sons property.. in fact part of the pipe is sticking over onto my sons property. Does my son have any recourse in this matter? Thanks For Listening.

Re: Water Run off from neighbors property

Your son absolutely has recourse. I had a similar case several years ago. The law will not allow a person to divert water from his property onto the property of another by artificial means. Your son needs to immediately retain an attorney to protect his rights. If he wants me to assist him, he can call me at 856-546-8010; If he mentions LawGuru, his first consultation is free. Good luck!
