Use of Name in Advertising
I am a Financial Planner and Registered Securities Represntative. I was affiliated with a firm, from which I resigned and moved my license to another firm. The prior firm told me very strongly not to use their name or indicate any assocation with them in any of my work. However, for six weeks after my leaving the firm, they still carried my picture and my biography on their website, which I had them remove. I was told by them that I was no longer being used in any of their promotional materials. A few days ago, I was found out that (new) promotional materials were being given out at a trade show that contained my picture and name again. There are legal implications in the securities industry about my showing an affiliation with a firm if I am not licnesed with them, but there are also implications as a private citizen if my name and/or image is being used without my permission. My permission to use it only extended to the time I worked for them. Since they are warning me about using their name in my work, how are they able to continue to use my name and picture as they please, jeopardizing my professional status ?
