Legal Question in Social Security Law in New Jersey

child support and social security

I pay child support for a disabled daughter who is also collecting Social Security on my work record. I am retired collecting social security for myself. My daughter was collecting SSI for her disability until I started to collect at age 63. I would like to know if it is legal for her to collect child support from me( out of my monthly check) and social security on my record. I would think that her collecting on my work record would compensate for me having to pay child support out of my social security check. this has been an on going battle and no one seems to have the answer...is it LEGAL? THanks for your time.

I tend to agree with you that her collecting on your work record would

suffice as child support - or at least be counted as a major offset for support.

BUT SS regs have nothing to say about this.

This is a matter for NJ child support law. You should re-post this under Child Support law and look for a NJ lawyer who has experience with such matters.
