Legal Question in Social Security Law in New Jersey
My husband and I started to collect social security benefits at age 62. He died at the age of 68. I am wondering if I should be getting his benefit and not mine?

You cannot receive his benefit but you may be eligible for a Survivor's or widow's benefit if you are:
A widow .. full benefits at full retirement age, or reduced benefits as early as age 60
A disabled widow or widower -- as early as age 50
A widow ... at any age if he or she takes care of the deceased's child who is under age 16 or disabled, and receiving Social Security benefits
