Legal Question in Social Security Law in New Jersey

Is there a law in regards to garnishing a person's wages when that person was getting benefits from a parent that was on SSD, and the child was a minor at that time and was under the parent's care at that time. This person is now 27 yrs. old and SSD claims that there was an overpayment for myself and my son. Also what is the amount that can be garnsihed from my wages, and how is this determined?

Garnisment or wage attachment is a state law matter. So re-post that question in that area.

If the issue is a Social Security overpayment, you should file a Reconsideration form to appeal and ask for a review of the Overpayment determination. You can also file a Waiver form stating tha: 1 you were without fault in the overpayment and 2 that you have no funds to repay.
