Legal Question in Social Security Law in New Jersey

survivor benefits for children after divorce

My ex-husband passed away leaving our 8 and 11 year old daughters. Do they qualify for survivor benefits from SSI and what I will I need to apply? (Child support order, etc.).

Re: survivor benefits for children after divorce

If your ex was working and paying his FICA tax, his minor children should be eligible. Unmarried children who are under age 18 (or up to age 19 if they are attending secondary school full time)can receive benefits. Check out: http://www.ssa.gov/pubs/10084.html

The information needed by SSA includes:

Proof of deatheither from a funeral home or death certificate;

Social Security number of the deceased worker;

Dependent childrens Social Security numbers and birth certificates;

and a few other documents

call SSA or go to the local office (this site does not allow me to give you the SSA phone number so look in the blue pages of the phone book; or www.ssa.gov)
