Legal Question in Tax Law in New Jersey

Non resident tax

I was laid off work-last day worked 12/31/04 in New York. January 1, 2005, I moved to NJ. My severence check was mailed to my NJ address. I received my W2, actually 2 W2's from my old company. They took tax out for both NY and NJ. Both states show the same wage amount. If I lived in NJ the whole year, why did they take tax out for NJ? Just because I received the money in 2005 at my NJ address?

I am not sure of what happened without seeing the actual Forms W-2. It sounds like you got one W-2 for your wages and another for the severance. Since you had moved to NJ in the interim, this may explain it. If they are identical W-2 forms, they may have paid state withholding to both states, on the same wages. This is unusual but could happen. I need to see the forms and I may have a few more questions afterwards, to give you the proper answer.
