Retainers

Just wanted to know how long a retainer can be held by an attorney? Thre retainer being held is from a project done in 2002. The project is complete and attorney is only used now for tax advice. Does firm still have the right to hold the retainer? Is there is a time limit? Thanks

You do not provide enough facts to give a proper response. Was there a written retainer agreement? What does it state? Is the project covered by the retainer completed in all respects, or are there still open matters (such as the on-going tax advice)? Did the retainer exceed the costs of the project? Have you asked the attorney for an accounting of the retainer? Has he responded? If you are entitled to a rebate, you can request an accounting and ask for prompt disposition.
