Legal Question in Tax Law in New Jersey
The state government claims I never filed a state tax return from 2001. I have no records dating back 8 years. If I had a winning state lottery ticket for over $600.00, (where I'd have to mail in a claim form in order to collect the winnings), can or will the state withhold the money until the return from 2001 is filed? Please advise. Thank You.

The state should not withhold the lottery winnings because you are not making a payment toward your income tax liability. They may however withhold income tax from the proceeds. They can however still audit you for 2001 because the statute of limitations on the claim has not started to run on that return unless it was timely filed.
