niece's husband sold a business and died shortly after. Does the
spouse have to pay all the capital gains or does the estate carry some
responisibility

Your niece should immediately retain a tax attorney. Depending upon the assets in her husband's estate, it may be advantageous to file separately. The Agreement of Sale, settlement documents, and other income information should be presented to the attorney.
