Legal Question in Tax Law in New Jersey
My wife has a $3000 tax lien from 1994 on her credit report due to her ex-husband filing for bankruptcy during their divorce. The lien has been causing us problems while trying to refinance our mortgage. I read that there is a 10 year statute of limitations. How can I find out the status of the lien?

Tax liens must be periodically renewed. You can check in your County Hall of Records what is the current status. Also, since you are considering refinancing your mortgage, the title company should be able to check this for you. Finally, if the lien arose through a marital matter, you have the right to put an explaination in your credit file so you can do this for all credit agencies. If the lien has been removed, give proof to the credit agencies and they will either remove it or provide some further information.
