Legal Question in Traffic Law in New Jersey

39:4-81 Please advise

We had an accident at rt35,shrewsbusy,nj. we received ticket from police stating ''court apperence required'' indicating offence 39:4-81.

It was an accident where both cars are damaged up to some extent ,not too much.both were drivable, no bodily injury for anyone.

now will you please tell me whats the procedure for insurance?

we were told to collect the police report from the police station after 7 days, now we are afraid of the points on driving history, and the fine we have to pay at court, and wheather the insurance premium will increase ?and now our car reparing and other car repairing will cover by insurance or we have to pay for that?our policy is comprehensive. can somebody help?

The ticket you are charged with carries 2 points if you are convicted or please guilty to it.

Since it apperas from what you have stated the accident was your fault, more likely than not your insurance will go up but that is really a question for your company.

Your company should pay for the damage to the other car and should pay for the damage to your car if you have that coverage minus your deductible.

You need to have your attorney sort this out for you. First, if you received a ticket for the accident, then you need to fight that on the criminal side. Once you have done that, you can claim against the insurance company for your injuries, losses, lost wages, etc., but it's a complicated process. Give our offices a call. You were charged with failure to observe a traffic signal. If the officer only ticketed you, he probably believes you were responsible for the accident. There is a way to keep the result from being used in any civil case. Give me a call at 877\688\3879.
