Legal Question in Traffic Law in New Jersey

39:4-94.2b

I got a summons to appear in court for trying to get to my house when there was a parade on my street. I received no notification that I was not going to be able to get to my house. I was coming home from work. The roads were blocked but I assumed I would be able to get to my own home. The parade was ahead of me, I am not sure if there was anyone behind me, I believe there wasn't. Can I defend this?

You were charged with knowingly driving on a closed road. There is a fine for that but no points. It is probably not worth hiring a lawyer unless you want to fight it for the principle of the thing. Call me if you would like to discuss it further at 877*688*3879.

This charge has a penalty of a fine not to exceed $100.00. If the road was closed, under the statute you weren't supposed ot be driving on it. You have to decide if it is worth your time to fight this ticket. I imagine that the only defense you have is No Knowledge That The Street Was Gooing To Be closed, but I don't know if this is true or not.
