78 in a 45/NJ

My fiance was going 78 in a 45 in NJ and got a ticket. going that fast wasnt even listed at the bottom of his ticket so we have no idea what is going to happen. Im really worried :( Im pregnant, he cant lose his license he needs it for work.

Don't go into labor over this, it's not that bad a situation. First, go have him get his driver's abstract from DMV, any atty you go to would like to see that anyway. Does he have other violations and any points? Was he polite to the officer (remember, you can never WIN argument with an officer, only the best you can do is break even!). There is a 0 points ticket, called "Unsafe driving", but it has a $250 surcharge that goes with it (yes it is just another way to screw the public and make more money for NJ - don't get me started), and if you get 3 in 10 years, you get 4 DMV points. You can get an attorney for about $400-$800. I'll tell you what I tell my brothers and friends - 99% of the time, you will not have the skills necessary to assure you the best results even in municipal court, so it is a shame, but you can not afford to go to court without an attorney. I sit in court and listen to people plead to summons, where I now it will cost them much more later in insurance to go to court w/o an attorney. Get the money even if you need to borrow it. It is possible, though unusual for a judge to take away someone's license just for speeding, but it can happen. Also, 95% of the time we are not told ALL the facts that may be relevant, so, his driving record, how he acted to the officer, his criminal background (if the cops know it it can be a factor, even if it is to discourage him from even driving through their town), etc. etc. I'll be honest, I check out any judge and prosecutor I am not familiar with before court. I check to see if there is any town ordinance I can talk the prosecutor into (which does not get reported to DMV). I try to get the cop and prosecutor to laugh and when I meet resistance, I tell them they have to cut me a break because I made them laugh, which gets them to laugh again, and people are people, it helps. Some people say find a local atty who knows the judge, well, that can't hurt, but I think an atty that gives a damn and has the best personality CAN make a significant difference... Get his DMV record, and go find an atty you think will give a damn about getting you the best outcome and spend the money - you may feel it sucks, but that is your reality, and you have to deal with it the best you can. Your fiance has a serious problem, but Attorney Begley is right, it is not the end of the world.

Your fiance needs to not drive like an idiot. but you knew that already.

Please have him hire an attorney. A good attorney should be able to protect him from the worst punishment.

And get him to slow down. He is going to be a father soon, and that child needs him.
