Legal Question in Traffic Law in New Jersey

Amend to Unsafe Driving, how many times?

Hi, i was just wondering if anyone know how many times can you have the presecutor to make your traffic violation ticket to a no points unsafe driving.

I was told that you can do that twice by someone. And What happens if you did not remeber that you were charged with unsafe driving more than allowed and you went to court and have the presecutor charge you with a 3rd unsafe driving?

Thanks.

Under New Jersey law, you can be convicted only twice for Unsafe Driving (NJSA 39:4-97.2) for it to remain a zero point violation. For a third conviction, there is a penalty of four points on your driving record. If you cannot remember how many times you have been convicted in the past, you can ask the prosecutor - they should have a copy of your driving record with them.

I am an attorney who has handled violations similar to yours many times in the past. Please call me at 908-272-0111 to discuss your case. There is never any charge for simply discussing the charges against you. Thank you.

You get 2 bites at the apple for the "no-ponit" ticket. If you get a third 39:4-97-2 then you get stuck with double the points (4). Make sure you do not have 2 before agreeing to a third because the point total may be lower for the actual charge then the "baby careless" ticket.
