Legal Question in Traffic Law in New Jersey
Auto accident case
I live in NJ and was in a car accident. A truck hit my car from the rear while i was waiting for a school bus to drop off some kids. The driver begged me not to call police, that he will repair my car. I took the car to a body repair shop and made sure he was involved every step of the process for 3 days until the car was fixed. Now he is dodging the payment and my car is still in the shop. I did not sue or ask for personal suffering just to get my car fixed because it's my only means of transportation to work. I don't think it is fair that it should happen this way.
My question is, if i want to bring law enforcement or bring the court into the situation now, what will happen? do i have a chance in winning this or what steps can i take. i don't know what to do at this moment. Any response will be appreciated. thanks.

Re: Auto accident case
You could probably still file the complaint for the accident (when did it occur?) NJSA 39:4-130 requires you to report any accident resulting in more than $500 property daqmage. Failure to do so could result in a fine up to $100. This does not, however, limit your recourse against the other driver. If push comes to shove, (sounds like you need the car) you can pay the shop yourself and then go after the other driver in small claims (depending on how much damge there was). Contact me with some more details and we can take it from there.
