Legal Question in Traffic Law in New Jersey
Auto Accident I was Involved In
I rear ended a car at a traffic light. The police issued me a ticket for Careless Driving. IF I plead guilty, can my insurance company have surcharges even though its ONLY 2 pts - which would--name removed--the only 2 pts I would have on my driving record. There was minor bumper damage to the other persons car but no personal injury to the other persons involved. I would like to know if i should just plead guilty and take the 2 pts. OR plead not guilty and try to get the points taken off my driving record.

First of all, you have to be careful here because there was an accident. I assume that you are young only because you think that they won't sue you. If you live long enough, you realize that anyone can sue you for anything. Thus, I would see an attorney before doing anything.
With regard to the points, don't listen to any attorneys that say your insurance will go up. They are trying to take your money. Your insurance company cannot raise your rates for just 2 points. However, if you get another ticket in the next year, you are looking at a big problem.
This is a very minor issue and it should be very inexpensive (relative to my normal practice anyway) for you to hire an attorney. Your other option is to fight the case by yourself.
My initial consultations are always free, so call me at 732/247/3340 to discuss your case. My office is right around the corner from you.

It is really just a matter of how much money you have. If your money is scarce the $430.00 in fine, state surcharge and court cost is really not
a workable solution. For two points your insurance may not increase that much, for three years. If you have lots of money you should seek the usual no pointer because you will save some money each of three years.
