Legal Question in Traffic Law in New Jersey
Auto accident and shoud she or shouldn't she?
Yesterday,my mom (84 years old) was waiting at a light to make a left turn. The light turned green and she started to make the turn and was struck by another auto coming from the opposite direction. The car that struck her ended up behind her facing in the same direction as her car. Both cars were totaled but fortunately no one was hurt. That is ... for the time being anyway. My mom told the officer that she didn't see the car coming, was making the turn and that it was her fault. So, she received a ticket and she was told today that there is also a witness. She just wants to go to court and plead guilty but .. I think she should have a lawyer to help her out even if she is guilty. Is it worth it? I personally think that her reflexes are to slow and she shouldn't be driving anymore which is something to be discussed by the family.

i do believe you need an attorney for two reasons:
1) you want the traffic ticket taken care of for the lowest amount possible and the least possible "punishment" by the courts. maybe have her pay a fine, no points (so her insurance stays the same).
2) you dont want your mom to make the wrong statement in a traffic hearing that could be used against her in a civil hearing for monetary damages if the other party that was involved sued her.
call my office if you are interested in discussing in more detail.

I suggest she call an attorney (or better yet, you call) and discuss this over the phone. The ticket itself might not be that big of a deal, but if someone is now claiming that they are hurt, it could be a big deal. If she doesn't need her DL anymore, than points won't really make a difference.
My initial consultations are always free, so call me at 732/247/3340 to discuss the case.

A lawyer could ask the judge to seal the record so that her guilty plea could not be used against her in a civil case.
Call me if you like.
