Backstabbing Officer

I was stopped for speeding on the 8th of december and the officer was nice and let me go with a warning and gave me a ticket for unclear licence plates. I paid that ticket and the day that check cleared the 8th of Jan. I recieved a ticket in the mail from that officer for speeding, the tickets were actually consecutive numbers and wrote the same time on both tickets. When I go to court can I plead not guilty and claim that I was not speeding or should I ask the judge to throw out the ticket because of the absurd nature in which I recieved the ticket.

Sounds like a raw deal, but unfortunately the best you will be able to do is hopefully get a "no-pointer." There is a chance, however, you may have an argument that the police officer waited too long to write the speeding ticket. The statute of limitations is the time within which legal actions must be started.

Beyond any arguments based on the Statute, if he could rightfully ticket you for speeding, there is probably not anything improper about him later mailing the ticket.

You really have no defense as to the receipt of the ticket. The officer has the right to issue a ticket, even if he said that he is only giving you a warning.

What you can do is have an attorney plea your ticket to a no pointer. Where you would have no points on your drivers license.
