Careless Driving

I was involved in an MVA as I fell asleep behind the wheel. There were no other vehicles involved in the crash, but I hit a tree on the side of the road. I was put into an ambulance and I was written a ticket for Careless Driving. A few days passed after the accident and I was issued an order to appear in court. What are the possible fines and/or punishment?

You are looking at fines, possibly as high as $150.00 or more, plus two points on your license. In addition to this, you may be receiving a bill for the damage to the property that you caused in the crash. Finally, your insurance company may raise your rates simply because you were involved in an accident. In theory also the judge can suspend your license for the accident, although in reality it rarely ever happens (although I did see it happen once). This may or may not be worth hiring an attorney to defend you, depending upon your driving history and how much money the insurance company will charge you. call your agent and get a STRAIGHT answer as to what the surcharge will be. usually, the insurance goes up for three years.

you may be able to fight this. if there are no witnesses, then the prosecutor will not be able to prove HOW the accident happened. if you spilled your guts (as almost all people do) then you have a bit more to get past.

Points: careless is 2 points assessed by NJ DMV. this is NOT the same as the points assessed by your insurance company.
