Legal Question in Traffic Law in New Jersey

careless driving

I received a ticket for careless driving going into the Holland Tunnel. A NJ transit bus almost ran into the side of my car on an alternate merge and I got the ticket. The ticket did not have the correct information (ex. birthdate wrong, gender, and no driver lic number) I am scheduled for court next week, what can I do about this?

You have four choices:

1. Ignore the ticket completely;

2. Plead guilty, pay the fine, and take the points;

3. Negotiate with the prosecutor for a less serious charge ("plea bargain"); and

4. Plead not guilty and have a trial.

I definitely do NOT recommend choices one or two. Regarding choice three, depending on the circumstances, you may well be able to negotiate a disposition that results in your obtaining zero points. You would still have to pay a fine, however, and you would still have a record of conviction for a moving violation. You avoid those penalties with choice four, if you win. If you lose, of course, you have the fine and the points.

I hope this helps.
