careless driving ticket

I received a careless driving ticket on an early Monday morning (2:45am) while driving home from work. The weather was clear and there were almost no cars. The officer gave me the ticket on grounds that I was weaving. I was actually 1/2 a mile from home and was simply changing lanes to get to the exit off the highway.

My driving record is clean except for 2 points from last year. My question is how should I approach defending myself in this case. I absolutely do not want the points but I do not care about the fine from the ticket. What is the chance that I can get that?

Any help, tips, suggestions would be greatly appreciated. Thanks.

Please be advised that I have not been retained and I am basing this response on limited information supplied. However, if your driving record is clean and you were cooperative with the officer, there is a great chance you could have this violation reduced to a no point ticket. It always depends on the porsecutor's willlingness to negotiate and then the judge's willingness to agree, but more often then not, if you or your attorney call the prosecutor ahead of time, or if you show up in Court on the appointed date a few minutes early, you can work out a deal to get rid of the points. Provided that you were cooperative with the police officer and it was just a standard stop with the ticket, the chances are strong that you will be able to arrange a guilty plea to a "no-point" ticket. An attorney can help you in discussing this with the prosectutor, or you can sometimes arrange it on your own. Exactly how things are handled frequently depends on the Court you are dealing with.
