Legal Question in Traffic Law in New Jersey

Citation- Load as to spill-Statute No 39:4-77

Date 2/16/2005, 5:00am. I80 West, Mile marker 120. Teaneck, NJ-Bergen County

Resulted from an escort car falling of a large truck. Car was chained and secured and chain hook may have pulled through car chassis. Although the Citation shows no injuries, a passenger car swerved into the guard rail and the passenger side occupant suffered bruises.

State Police would not allow examination of damaged car to determine cause at the accident site. Liberty Mutual Insurance has my statement as well as info and as of yet have not examined car. Liberty Mutual will not provide legal councel for me, only for my employer.

I have a Court date of May 4, 2005.

I have pleaded Not Guilty.

I secured the car in accordance with Vehicle Carrier Code 75, chapter 78. Motor Carrier Safety. Even when properly secured, the car came off. I do not know how.

How can I defend?

What is required is immediate inspection of the vehicle in question, under subpeona if necessary.

You should call to discuss the case and should obtain the assistance of an attorney immediately.
