Legal Question in Traffic Law in New Jersey

If I defend myself in traffic court and lose...

Lets face it, there is a strong chance of me losing the case if I go in to defend myself.

If I did lose the case, would the judge add extra fines and penalties or just make me pay the original ticket amount? If I presented my case in an organized, logical and tasteful manner, will they penalize me for bringing it to court?

That all depends on the judge. You cannot be penalized for brining a case to trial, but when the judge has discretion in the amount of the fine, the judge is more likely to give you the highest amount. If the fine is only one dollar amount, then there would be nothing to really lose to take it to trial. However, in those cases, the prosecutor would give you a better deal.

If you lose a traffic case in municipal court you are responsible for court costs regardless of whether an attorney represents you. What an attorney may often be able to do is get you a deal in which you receive less points, or even reduce your violation to one that is zero points.

If you have a ticket that is more than a two point violation I suggest that you contact an attorney.

If you would like to discuss the matter feel free to give me a call.
