Legal Question in Traffic Law in New Jersey

What is discovery?

Please let me know what is in discovery that they give you when you are pulled over for speeding. Does the read out actually show you your actual car's read out?

Re: What is discovery?

THERE'S NO RECEIPT FROM TEH MACHINE. IT'S WHAT THE OFFICER WRITES EITHER IN A REPORT (USUALLY ON THE FACE OF THE TICKET) AND WHAT HE WRITES ON ANOTHER FORM WHERE HE LISTS THE SPEED OF YOUR VEHICLE, ALONG WITH THE CAR DESCRIPTION, ALONG WITH ALL THE OTHER VEHICLES HE MAY HAVE STOPPED BEFORE OR AFTER YOURS. SOMETIMES YOUR VEHICLE IS THE ONLY ONE ON THE LIST. THE POINT OF THE DISCOVERY IS TO CHECK WHETHER THE RADAR/GUN WAS CALIBRATED CORRECTLY BEFORE USE.

Re: What is discovery?

In a speeding case the discovery consists of documentation showing that the radar gun (or laser gun) used to register your speed was calibrated properly and also that the person who wrote you the ticket was currently licensed to operate that machine. It also usually contains a list of all the people stopped for speeding by that officer around the same time as you were stopped. If he uses a Pace test, then he has to show that his car's speedometer was properly calibrated by providing documentation to that effect. I am an attorney who has handled many cases similar to yours in various municipal courts in New Jersey in the past. Please call me at 908-272-0111 to discuss your case in more detail. Thank you.
