Legal Question in Traffic Law in New Jersey
Driving wife's car
while driving home from work not speeding or anything..police rolled up next to me looked me in the face ..ran the plates (wifes dl's are suspended)...waited for me to come back past him as he looked me in the face again. I stopped at the traffic light and he decided to swoop in behind me and thro his light's on. I got out to ask him directions as I knew my dl's were suspended (surcharge)..He asked about my wife and then gave me directions, then told me to pull over and he would give better info. Then he proceeded to ask for my info and gave me driving while suspended ticket..can I beat this on the grounds that there was no reason to pull me in the first place? Can I file a motion to supress?

That is a tough one because you asked him for directions so an argument can be made that you started the contact. On the other hand, he put his lights on first and you are clearly not your wife. Your case will not be easy, but I am sure it can be won. I would need more information to help you.

If the registered owner of a car has a suspended license then the license plates of the car registered to them will reflect that their license is suspended. The police have the legal right to run license plates to see if the owner of the car has a suspended license or warrants for their arrest. The police had the legal right to run the plates and pull you over. What's left to do is address the ticket for driving while suspended that you got.
