Entrapment

Dear Law-Guru Research Assistants:

This evening I was pulled over and written a summons by the local police. It was dark and the police car was not visable at all. What are the NJ entrapment laws. Do the police have to be visable to the motorists while parked in a private driveway?

Unfortunately, it is not entrapment for the police to simply hide.

Entrapment means that the police actually caused/encouraged you to commit a crime and then arrested you for it, not that they just happened to see you without announcing that they were watching.

With that said, however, there may be a chance to reach a plea agreement whereby you plead guilty to a lesser charge thereby avoding fines/points.

The police do not have to be visable. What was the summons you were issued. The more important question you should have is "was there probable cause to stop you?" Hiding is not entrapment. Entrapment is conduct on the part of the police or their agents which causes an individual to engage in criminal conduct not contemplated by him. One who sells drugs can not claim entrapment if a police officer or agent buys drugs from him or her because the act was contemplated prior to police involvement.
