failure to yeild to a pedestrian

I was driving down the street and saw the yeild for pedestrian sign as well as the cross walk, it was empty. Then I see a man step off of the next curb not in a cross walk. As I drive by I see the man radio down to the cop waiting at the bottom of the hill. The man was not in a cross walk. Does the pedestrian have the right of way even if they are not in the cross walk?

What kind of answer are you expecting? something like: ""No, if they are not in a crosswalk, then you are allowed to hit them.

It does dent your bumper, though. And they make a lot of noise."

You must take care to not injure pedestrians, other motorists, bicyclist, dogs and all others on the roads. If you see them, yield. Avoid accidents if you possibly can.

That's called jay walking. Here's your problem, the cop is going to say he was in the cross walk. You should really call an attorney to help you with this.

The applicable law makes an offense for a motor vehicle to fail to yield to a pedestrian who is in the crosswalk. It also requires that a pedestrian standing on the sidewalk not step into the street when a motor vehicle is so close that it might not be able to stop.
