Legal Question in Traffic Law in New Jersey

If you have are fighting a traffic violation and the officer does not show up to court - twice now - should the ticket be dropped? The prosecutor said my son must continue to show up a court until the officer shows...or PAY it! My recollection is that the case would be dropped if the officer doesn't show. (Camden County, NJ) Thanks!!!

The correct procedure is to ask for the dismissal of the case the next time the officer fails to appear and if the request is denied by the judge, ask the to set a date on which the case has to

be tried or dismissed. This approach works better with a lawyer.

I guess you see why people bring lawyers to Court....especially in cases that appear to be somewhat serious. I seem to think your son may have a lot at stake here, and that is why the prosecutor doesn't want to let it go.

In any event, you need to appear at least two more times. Once to see if the officer shows (if not, you can request a reason why he hasn't attended and demand it be tried) and then the next time to get it disposed of, one way or the other.
