Legal Question in Traffic Law in New Jersey

Leaving the scene of accident; please advise

I tried to park into a parking space.

When parking, my car touched the car next in the parking..

A minor scratch occured to that car and a screeching noise was heard.

I pulled out of that parking space and parked in another nearby parking space because this

space seemed bit narrow due to the way the other cars were parked.

Meanwhile some person who noticed it, stopped me and said that I am supposed to leave my

registration,insurance details on that car(scratched).He said that I am leaving the scene. I argued that I would like to inform the parking authorities

first and I was not leaving the scene. I said : I will rather inform parking authority which is

in the ground floor. We went down to office. Parking authorities

called the police. Witness noticed a nearby cop. He called him and said that I caused an accident

and I was trying to leave the scene. The cop listened to him. He then asked me a question - 'were you

trying to leave ? ' I said yes but wanted to say that I infact left the accident spot and

went to the parking authority office to inform. The cop inspected the car which had scratch.

He said there was a minor scratch and registered it as an accident.

He then gave me a ticket for 'Leaving the scene '.

You should never have answered "yes" when the cop asked you if you were leaving the scene because in fact all you were doing was reparking your car before reporting the incident. Now you are facing a charge that requires a mandatory loss of your driver's license if you are convicted. I would advise you to hire a lawyer to help you out of this mess. Leaving the scene of an accident, where there is no personal injury, requires a six month suspension of your driving privileges if you are found guilty or plead guitly. Your facts make you not guilty, but you need an attorney to make this happen.
