Do I need legal counsel for a Tailgaiting ticket ?

My son with a provisional NJ drivers licence had 3 other minors in his(my)car after school. 2 of the boys would hit my son over the head if he didn't do what they said which was to follow a couple with 2 children in a van from the park to their home. He dove close to them 10 feet or so. The lady called the police after she got home discribed the action and the car. The police stopped them and gave them a ticket for provisonal licence with too many minors in the car. 1 week later we received a ticket in the mail for tailgaiting as the woman went to the police station 5 days after the occurance and filed this claim.

Do I need to have a lawyer for my son? It is his first offence. Will it be dropped if she doesn't show up in court? How would a lawyer help?

Tailgating is a 5 point ticket and your son would lose his license for at least some period of time if he gets these five points. the ticket would only be dismissed on motion if the case goes to trial and the other person doesn't show up. Your son can go to court on his own and try to talk to the prosecutor about reducing the ticket to one with fewer points, but he would probably be better off having a lawyer assist him in this. Although you don't HAVE to hire a lawyer, I would recommend it under these circumstances. If it was just a two point ticket of some kind I would say he could probably do it alone. However, with a five point ticket things could get complicated. I am an attorney who has handled many cases similar to yours in various courts in New Jersey in the past. If the lady went to the police to file an additional complaint she will appear in court.

Your son needs an attorney. Tailgating is five points.

The case as a whole is not going to get dropped without a lawyer. Without a lawyer, they might shave off two points, that's about it.
