Legal Question in Traffic Law in New Jersey
Lessening sentence for driving without insurance
Hi! I was sentenced to a year license suspension for driving without liability insurance in New Jersey. Six months into my suspension, I have written the judge a letter asking him to considering reducing my sentence. What are the odds he'll grant me the wish?

Re: Lessening sentence for driving without insurance
Driving without insurance is taken very seriously in New Jersey. In order to reduce your sentence (or any sentence), the court must have both 1) a legal and 2) a factual basis to support a reduction in sentence. Further, since assuming 1) and 2) both exist, the judge also must have a reason to exercise whatever discretion exists, you must be able to 3) provide a convincing explanation for why the judge should "cut you a break."
There is absolutely nothing in your question to indicate what circumstances have changed or any other reason given which would tend to persuade a judge to reduce your sentence. Therefore, without providing more information, it is impossible to determine whether there is any likelihood that a judge would reduce your sentence, even if legally able to.

Re: Lessening sentence for driving without insurance
Unfortunately, in New Jersey there is a mandatory one year loss of driver's license for a conviction of driving with no insurance. Since that is written right into the law, the judge cannot do anything to lessen it. I am an attorney who has handled many cases similar to yours in various courts in New Jersey in the past. If you have questions about this or any other legal matters, traffic court or otherwise, please call me at 908-272-0111. There is never any charge for simply discussing a case with me. Thank you.
