Legal Question in Traffic Law in New Jersey

I live in NJ. I was driving the speed limit (MPH), and a car pulled out without stopping at the stop sign. They then slowed down to MPH. I honked my horn at them. And when the road became 2 lanes, I passed them and gave them the finger.

The driver of the other car, then quickly pulled up next to me and flashed his badge, making me pull over. I had no idea he was a cop, as there were no markings on his car. He's a lieutenant

He called in for a patrol car to pull up and assist him. They took my license, insurance, and registration. They went back to their cars, and did whatever they do.

The lieutenant then handed me my paperwork back and said there will be a summons mailed to me. I was then free to leave.

I was never told what exactly I was pulled over for.

Is this legal? Can I fight this if I actually get a summons?

You are lucky the other driver wasn't a road rage, gun carrying misfit.

You can indicate at court that you did not know it was a policeman...you also have the defense of "freedom of speech" which MIGHT work, but you should apologize to the police officer certainly, or better yet, let YOUR ATTORNEY do it for you

You definately have the right to fight any summons that the Officer may issue to you, at the time you posted this question you do not know what that is, and it is difficult to advise someone about what to expect when they have not yet received a summons or maybe several summonses. It is legal and the Officer can pull you over if he feels that you have done something illegal. Giving the guy the finger does not help, but whether you actually are guilty of an actual traffic violation would be up for a Judge to determine if you choose to go to trial. feel free to call with any questions (201)-894-9498
