Can Motor Vehicles issue Tickets
My son in law was involved in an accident last December 2008 in which there was a fatality. The police investigated, his car was impounded and there was no evidence. It was determined the accident was avoidable. No tickets or any charges were filed by the police. Now 8 months later he gets a letter from MV saying his license is going to be suspended for 18 months for careless driving. Can MV do this?

I understand that you mean that the accident was termed "unavoidable". The answer to your question is that the DMV can administratively suspend a person's license for being involved in a fatal accident. There is a procedure for challenging the suspension. This may result in reducing or eliminating the suspension. Call me if you would like to discuss it further at 877*688*3879.

It can, but your son has a right to a fair hearing and to have the suspension held in abeyance until the hearing is conducted.

Can Motor Vehicles issue Tickets
The Motor Vehicle Commission can issue the Notice of Proposed Suspension. That informs you of their intention. Unless you respond, that is what happens. Therefore you must respond. If you respond, there is a decent likelihood that you will receive a suspension for a lower period of time or, possibly, no suspension at all. You desparately need legal assistance on this matter.
