Legal Question in Traffic Law in New Jersey
NJ - DMV suspended sons license. 5 years ago, he was pulled over w/o papers due to papers being at home. Court dropped charges when papers were produced. DMV charged surcharge but never sent letter and now son is suspended. Is this legal? Does he have to pay the surcharge despite the charges being dropped?

I do not fully follow you. Why was he suspended in the first place? Why he is being assessed a surcharge? Is it for points? If he fails to pay the surcharge that will result in his license being suspended. He has to pay the surcharge. Why doesn't The NJ Motor Vehicle Commission have his correct address? I would have to review all the documents from DMV before I can give you an answer. DMV (Actually called MVC these days) does not suspend people for no reason, and I am trained in reviewing MVC documents to figure out why people find themselves in the situation your son does.
