Legal Question in Traffic Law in New Jersey
I took the NJ probational driver program class and now am in the 1 year probation period. I received a ticket in NJ for speeding. Now I'm subject to loss of license for 90 days. Is there anyway to get this moving violation down to something that won't be a moving violation? I know I can take the Unsafe Operation and only have to pay a fine and get no points, but I don't want to lose my license. If i take the Unsafe operation I won't accumulate points and if i accumulate 6 points in one year of driving i have to pay a 150 dollar surcharge. What can I do to avoid all this trouble? Should I opt for the Unsafe operation of a vehicle ticket?

It is possible, it all depends on the facts surrounding the offense. I have many of times resolved cases where during the probation period individual can keep their license.
I don't think you are able to downgrade offenses if the Judge knows you have a probationary license.
In NJ if you have a provisional license you cannot get an unsafe operation. If you would like to talk about your options and need legal help feel free to give me a call 732-247-3340
You cannot get an amendment to Unsafe Driving simply because you are a provisional driver. THe best you can hope for is to either try to get a lower speed with fewer points or take the dcase to trial and try to flat out win the case. Please call me to discuss your case in more detail. I never charge for simply talking to a person about their case. Thank you.
