Legal Question in Traffic Law in New Jersey

Officer didn't indicate speed on ticket

Officer pulled me over, and issued two ticket(Speeding) and Careless(Excessive Speed). I don't understand why he has issued two tickets for same reason. Anyway, he didn't put checked mark on ''Excess of speed limit by'' nor write how fast I was going. He only write Statute No which indicate no speed at all. Is this ticked invalid? Can I get dismissed by faulty ticket? Although he mentioned how fast I was going verbally after I asked, I believe court will count more toward document rather than verbal conversation, right?

Also, can I visit court in two sepate date for two tickets? For example, taking care of ''Careless'' ticket first since it's only two points which I can probably get no points by talking to Prosecutor and paying fine. Then take care of speed ticket later..

Re: Officer didn't indicate speed on ticket

In New Jersey, the fact that he did not write down the speed on the ticket will not automatically get the ticket thrown out. You are currently facing 4 or more points (2 or more on the speeding, and 2 on the Careless ticket).

You should retain an attorney to assist you in minimizing or eliminating all the points on your summones.

You defense that the officer did not write down the speed on the ticket will not get you far as he will amend the summons to indicate the speed.

Re: Officer didn't indicate speed on ticket

There is a statute which requires that the ticket include the speed. If the officer does not amend the ticket within 30 days of issuing it, then the ticket will be defective. It is better to go to court once rather than on seperate days. Either way, you should go to court with a lawyer b/c you need to know how to convince the court that the officer did not follow the law. Also, if u go to court within the 30 days, he can amend the ticket in court, right there on the spot. call me 201-646-9799
