Legal Question in Traffic Law in New Jersey
Parkling Lot Accident Caused by Traffic Director
I was recently in a parking lot accident. I was backing out of a space under the guidance of a parking official in the lot. The man was telling me to pull out and i could not completely see around me as i was doing it due to terrential rains. I was going very slow around 3mph and i struck another car that was behind me. (I Don't know if it matters but as i was backing out the woman i struck did not honk her horn at all) The man who was directing me lead me straight into the other car that he was holding up. Is there any way that the traffic director who works for the YMCA, or the YMCA itself, could be held liable for the damage and have to pay for any of it? The other car was damaged more than mine which just has minor scratches. we had agreed to not go through insurance companies but now i feel like i am being ripped off from her estimate. What would be your advice in this situation? Also i read somehwere on line that in most parkign lot accidents there is a 50/50 liability where you just cover your own damage is this true?

It seems to me that the only negligent party was the one directing you to back up. Sue that person and/or his employer.

I agree with the other attorney, you should sue the person directing traffic.
