police entrapment

I had exited a parking lot in a appt complex when the police pulled me over. I was driving on the suspended list because of parking tickets. The officer told me he had run my plates a few weeks before and noticed my car again and waited for me to leave. Couldn't he have given me a ticket prior to me getting in my car and driving away? Why would he wait until I began driving away? Is this entrapment?

Of course it's entrapment. And it's legal! Why were you driving on the suspended list? Take responsibility for your actions.

Good question, and one that comes up fairly frequently. Entrapment is illegal, but there are limits on what is called entrapment. Entrapment means when the police cause you to commit a crime you otherwise couldn't have committed.

For example, if a police officer knows you are suspended and tosses you the keys and tells you to run an errand, that's entrapment. If he knows you are suspended, knows you are going to do it and waits to catch you, that's not entrapment. You don't have a right to require the police to save you from yourself.

You still may be able to beat it, but it's going to require fighting it on other grounds. I fight and beat a lot of these on issues such as notice. Get back to me if you want me to go over your situation with you.

They won't issue you a ticket for DRIVING while suspended until you are actually driving. This is not entrapment. No it is not entrapment......you decided on your own to drive. Driving While Suspended has very serious penalties including losing your license for 6 months if it your first violation. If you would like to discuss your case or the penalties, etc. further call me at 732/286/2170.

Entrapment is a defense to a criminal charge when the conduct or the police or a police agent is the operative cause of a defendant committing a crime. You were not entrapped; you were merely revealed. You need an attorney.
