Legal Question in Traffic Law in New Jersey

Pont System-Suspension

A few days ago I received a notice stating my drivng privilage to be suspended on 2-15-05 for 30 days. I received a 2pt speeding ticket in novemeber 04, which I paid on 1/05, This triggered the notice. It states I have accumulated 12 or more pts. The notice indicates 15 to be exact. I have had no moving violations in 6 years. I was under the impression 2pts. drop every successful completed year of no moving violations. Either way it seems ridiculous that because of a recent 2 pt. violation, I will loose my license for 30 days. It appears my points will stick with me forever. I am married, father of 2 infants, and the only one who works. The nature of my business requires me be on the road seeing clients, my livelihood relies on my driving ability. I am in the process of moving to FL by the end of the month, I am concerned if suspended, this will impede my ability to obtain a FL license, aswell jeopardize the ability to start as scheduled my new position. I've been informed about the 2 or 3 point reduction course. If I complete this or notify dmv of my intent to complete before the scheduled date will this prevent my suspension?

If you have not had any tickets in 6 years then you should have had between a 15 and 18 point reduction of the number of points on your license. Every year (12 month period) that you go without having any tickets of any kind, there is an automatic reduction of 3 points accumulated on your license. I would need to see your driving abstract before I can give you a definite answer as to why they are saying you still have so many points accumulated. Once I reveiw that, there may very well be a way to completely beat this pending suspension. It would require a hearing at DMV in Trenton, however. I am an attorney who has handled very many cases similar to yours in various courts throughout New Jersey in the past. Please call me at 908-272-0111 to discuss your case further. There is never any charge for simply discussing a case with me. Thank you.

You should request a hearing on appeal as soon as possible and hire an attorney. I have assisted numerous clients with you situation; having an attorney usually lead to the reduction of the suspension period. In your case it appears that Motor Vehicles has miscounted your points.

It sounds like you should be appealing this suspension. There would be a hearing with the state where you could bring up the correct amount of points you should have. If you would like to discuss the matter further please call me at 732-286-2170.
