Legal Question in Traffic Law in New Jersey
no probable cause for stop
An officer observed me with a missing front plate and correctly issued summons for plate and driving while suspended. Approximately 3 weeks later, after I had corrected the license plate issue, the same officer, pulled behind me at a gas station and asked for my license. He did not stop me for any traffic violation, it was night time, I was leaving the same establishment as the previous stop, I work there. My question is can he do this without probable cause (a traffic offense, bad tail light or some reason to stop me). Do I have a case based on no probable cause for the stop except for the fact that he stopped me previously. I could have been anyone in any car at night. I believe it impossible for him to be sure beyond reasonable doubt it was me. Please advise, thanks in advance

Re: no probable cause for stop
The police are allowed to run license plates to see if there are any outstanding arrest warrants or suspensions against the registered owner of the vehicle. If you still had not had your license restored then he would have grounds for pulling you over. I am an attorney who has handled many cases similar to yours in various courts throughout NJ in the past. I would like to discuss your case with you in more detail. What did he find in your car? If you are being charged with a criminal offense, you should get an attorney and let him or her worry about this. If you have not been charged with a crime, there is not much you can do. Even if he bothered you for no reason, he will make something up to cover himself. Furthermore, you have no damages so a suit will go nowhere.
