Legal Question in Traffic Law in New Jersey

What would be the procedure for a case like this?

My friend is being charged with

eluding 2nd degree,DWI and refusing

to stop. What would the procedure to

take??His bail is at $50,000 and has

no right for a 10% option, would he

face jail time??

He has a clean record.

The second degree eluding charge carries a maximum penalty of 10 years in state prison. The fact that there is such a high bail with no 10% shows you the seriousness of the crime. Your friend NEEDS a lawyer due to the seriousness of the charges. A lawyer can also try to get his bail reduced so he can get out of jail awaiting his trial. He is looking at prison time, 5 to 10 years. He needs an attorney and a good one. I suggest everyone forget about bail at the moment. The money is better spent on an attorney.

Hot pursuit of the police of persons who will not stop their cars has resulted in a number of deaths involving innocent people. Second degree eluding the police means that the person fleeing the police has driven his vehicle in a manner likely to place the lives of others, including the pursuing police in danger. A conviction for second degree

eluding requires a prison sentence, even for a first offender.

You might consider that having a clean

record means very little when one is

charged with rape or murder.
