Should my son get a lawyer or would a public defender do the same job?

In general, public defenders are decent attorneys, but they have a huge caseload and a limited budget. Therefore, you may not get the same level of personal attention that a private attorney can give. This may make a difference in how the case comes out. My advice is to get a private attorney if you can.

If you son's case does not require preparation and attention, a public defender is adequate. A public defender in municipal court deals with the public defender cases only when he arrives in court. He does give any case a lot of attention prior to going to court.

With all due respect to public defenders, nothing replaces a private attorney. That being said, there is rarely a choice as if you qualify for a PD, you probably can't afford a private attorney.

Your ability to hire the public defender is dependent upon your income. If you are facing a DUI charge then you should have a lawyer, whether public defender private attorney.
