Legal Question in Traffic Law in New Jersey
I got pulled over lastnight for speeding- I was going 40 on 25 fortunately the cop spoke to me and said he will not give me the speeding ticket but instead substitute it for another ticket which will not add points to my license. On the ticket he wrote "failure to observe traffic device" and the statute # is 39:4-120.9
I live in NJ and after searching through the statutes, 39:4-120.9 is defined as a "public-private intersection violation"
What should I explain to the judge on my court date? And what does a "public-private intersection violation" entail?

This is a zero point ticket with a low fine. If it was me, I would just pay the ticket and not bother even going before a judge. However, that is just my personal view and not legal advice. You have the right to a trial if you feel the ticket was issued improperly.

I agree with Mr. Aronds, the ticket is a no point violation and carries a low fine, the Officer cut you a break by issuing you this ticket instead of a potential 4 point speeding ticket for allegedly traveling 15 miles over the posted speed limit. Why fight it, but again that is just my opinion, good luck
