Legal Question in Traffic Law in New Jersey

Pulled over for tints and wrongful ticket

I was pulledover by local cop who had told me I was pulledover for tints. I took a class for for safety driving that was taught by a New Jersey State police officer and he had mentioned that in our state it is illegal to be stopped for tints. So, I had told him this, and he had replied with an attitude, ''I can't pull you over for tints?''. At this point I had noticed he was very mad with me. When he finally emerged from his car he had given me a ticket for tints and also for not wearing my seat belt. I had showed him at that point that I am wearing a seat belt. His response was that if I did not agree with my tickets I should go to court. My guess is he gave me the seat belt ticket incase I decide to go to court. He'll just say he pulled me over for the seat belt. My questions are, I am right about the fact I cannot be pulledover for tints, and whether I should try to go to court and fight this? My opinion is that the judge will believe the cop over me.

I have not ooked at the statute in a while, but last time I represented someonefor tints, I lost as it is a ticket involving the ability to see into someones vehicle and you cant obscure the view. I strongly suggest that you get a lawyer because the judge probably sees the cop every week and will take his side if you are unrepped. Thats just the way it is

Re: Pulled over for tints and wrongful ticket

HI,

your suspicions are correct. cops always pile on tickets to have an advantage for plea bargaining. they usually dismiss one in exchange for a guilty plea to the other one. your car may have gotten his attention because of the way it was customized. cops usually think these customzied cars contain drugs, etc.. anyway, these tickets don't carry points or surcharges, so in that respect you're lucky.
