Legal Question in Traffic Law in New Jersey

I received two tickets on my motorcycle...

I was making a left hand turn onto a highway. The officer was parked in the gas station on the side of the highway I was going onto. As I made the left onto the highway, just as I passed the gas station I accellerated quickly. The officer followed me for over almost two miles before pulling me over. He then asked me how fast I was going. I replied with ''I do not know officer''. he then suggested that he will put whatever number down that he wanted. He also wrote me a ticket for my shield (on the helmet) being up and not closed. The shield was infact open for a couple seconds but then closed. The officer wrote me a speeding ticket for doing 72mph in a 50 mph zone, but I dont think the officer knew how fast I was going, being I was out of his radar range, and I know I cannot accellerate from 0 - 72 mph in fifty feet. I didnt even accellerate until after passing the gas station.

If I take this to court, im sure the visor ticket will get dropped, but IF the officer cannot prove on documented paper that I was traveling at 72mph, will the ticket stick or get dropped?

The officer will have to show how he determined your rate of speed. If he clocked you on radar, he will have to produce the radar records, as well as certifications that the radar device was properly calibrated, and that he had the proper training to use the device. Even if the officer did not clock you with radar (or other similar kind of device), he still may testify that he visually determined that you were speeding, or that he paced you in his car. Based on your posting, I would say that it seems likely that you could plea-bargain to a lesser speeding ticket, or plea to an unsafe driving offense (depending on your current driving history). Mr. Moore must have some great courts by him. I practice all over NJ and in 90%+ of courts, you will get convicted even if you shouldn't. If you get an attorney, you may be able to increase your odds but it may be very expensive to do so. Your better shot it to work out a deal for a no point ticket with an attorney.
