Legal Question in Traffic Law in New Jersey

I was recently in a car accident and was taken to the hospital shortly after. Therefore, I never got to talk to the cop or the person driving the other car. I just got the police report back, but what they said happened did not happen as I remember it. Also they don't have a statement from me other than my shaken up response stating that I just remember going through the intersection with my light being green, being hit from the left side and spinning through the intersection. The police report says that I failed to observe a traffic control device. What should I do? Also note that I went to the hospital, had an xray and cat scan done, and also suffered a concussion because of this accident.

Although you say that the police reports states that you failed to observe a traffic control device, you fail to say if the investigating officer actually issued you a ticket for that offense. What you should do initially is go to the Police Dept where the accident occurred and advise the Officer that you disagree with it and wish to have it amended so that the report can include your version. A police report is not actual evidence as it is hearsay, it would not hurt for you to have the report include your version of events even if based on your limited recollection. If you were issued a summons which carries points you may wish to retain an attorney to fight it. However, if you were injured as a result of the incident then you really should consider consulting a personal injury lawyer and there are several ways to find one including going to the County Bar Association near where you live or just consulting friends about recommending you to an attorney you trust. if you were issued a summons and have any questions on a traffic related issue, please feel free to call (201)-894-9498, I never charge a fee for merely speaking to someone about their case.
