Legal Question in Traffic Law in New Jersey

I was recently ticketed for tailgating on Rt 9 in Old Bridge, NJ. I do not feel that the charge is fair as I do NOT feel I was in any way driving recklessly or follwing too closely - the officer was driving a few car lengths behind me on a dark, rainy, poor visibility night - I doon't even know how he could have a proper vantage point to assess whether I was driving too closely to a car a few car lenghts in front of me. As a 5 pt offense this is obviously considerd a very serious traffic violation which I was definitely not guilty of - what can i do to defend myself in this case?

I would not advise you to go to court alone on a five point ticket. You should discuss your case on the phone or in person with an attorney to find out exactly what the various options you have in this matter woudl be, either by plea bargaining or going to trial. I agree that you should retain an attorney as the ticket carries 5 motor vehicle points as you already know. The best way to probably defend yourself is with an attorney. You have two options, to either negotiate a plea bargain or take the matter to trial. Obviously if you strongly feel that you are not guilty then you can take it to trial. but it would benefit you to at least discuss it with a lawyer.
